Ankita Poonia Vs Deepak Poonia and Ors.

The petitioner assails order dated 22.02.2021 passed by the learned Additional Sessions Judge, Hisar, whereby the Appellate Court has declined to stay the impugned order as regards the vacation of the official residential accommodation allotted to the respondent/husband.

Learned counsel representing respondents No.1 to 3 has informed that the house in question stands vacated on 11.4.2022 and that the present petition is rendered infructuous.

Learned counsel representing the petitioner has not disputed the factum of vacation of the house in question.

As such, the instant petition challenging order dated 22.02.2021 passed by the learned Additional Sessions Judge, Hisar directing the petitioner to vacate the official accommodation is rendered infructuous and is disposed off.

It is, however, clarified that the aforesaid order would not debar the petitioner to have recourse to any other appropriate remedy as may be available under law including moving an application in the petition pending under Domestic Violence Act in respect of her requirements of residential accommodation.
