before this Court under Sec�on 439 CrPC seeking regular bail.

Reply dated 14.12.2023 filed by respondent-State is taken on record. Copy of the same has been supplied to counsel for the pe��oner in Court today.

Pe��oner seeks regular bail primarily on medical ground of his wife, however a perusal of the medical record reveals that medical record is of October which is two months old and it cannot be ascertained from the record that whether there is improvement in her health condi�on or further deteriorate. On this pe��oner counsel submits that pe��oner is confining in jail and there is nobody in the family who can provide her latest medical cer�ficate.

Be that as it may, pe��oner’s wife may get a medical cer�ficate from Local Physician or nearest Health Centre of the vacinity where she is residing about her health condi�on.

At this stage, counsel for the pe��oner wants to withdraw the present pe��on with liberty to file fresh pe��on for bail by annexing latest medical record. He further submit that he be permi>ed to file fresh pe��on without power of a>orney because it is difficult for him to take fresh power of a>orney since the pe��oner is in custody.

Given above, the present pe��on is disposed of withdrawn with liberty to file fresh by annexing latest medical record of pe��oner. It is clarified that there shall be no need to file power of a>orney in the fresh pe��on if filed and power of a>orney filed in this pe��on shall suffice. Registry will not raised any objec�on in this regard.
