Pe��oner seeks quashing/se2ng aside the impugned no�ce dated 12.10.2023 (Annexure P-8) issued by the respondent No.2 whereby the pe��oner has been asked to appear before the Forensic Science Laboratory (FSL), Madhuban, Karnal on 27.10.2023 for providing his voice sample in rela�on to FIR No.7 dated 11.04.2022 registered under Sec�on 7 of the Preven�on of Corrup�on Act, 1988 and Sec�on 409 of IPC, 1860 at Police Sta�on SVB Gurgaon, District State Vigilance Bureau.

Counsel for the pe��oner undertakes that the pe��oner shall appear before the concerned authori�es for giving voice sample on 18.01.2024, which date according to him, has been given by Forensic Science Laboratory.

State counsel on instruc�ons from Inspector Ishwar Singh submits that ini�ally the ma@er was delayed because of non-appearance of the pe��oner and now they have also received a communica�on that FSL has fixed date of taking of voice sample on 18.01.2024.

Given above, the present pe��on is disposed of with permission to the pe��oner to appear on 18.01.2024. It is clarified that if the pe��oner fails to appear except for the reasons beyond his control, then the State shall file an applica�on for cancella�on of his passport.
