The pe��oner apprehending the arrest in the FIR cap�oned above, has come

up before this Court under Sec�on 438 CrPC seeking bail.

Vide order dated 19.09.2023, this Court had granted interim bail to the

pe��oner which is con�nuing �ll date.

Counsel for the pe��oner submits that the pe��oner had joined the inves�ga�on and fully co-operated with the inves�gator.

Status report dated 21.11.2023 filed by State counsel today in the Court is taken on record. Copy thereof has been supplied to counsel for the pe��oner as well as counsel for the complainant. Based on the reply, State counsel does not dispute the submission of counsel for the pe��oner. On the other hand, counsel for the complainant submits that due to the act of the pe��oner, complainant, who was innocent suffered lot

and pe��oner is not en�tled to bail.

The allega�ons against the pe��oner were that ini�ally he in connivance with inves�gator had falsely roped complainant and a@er the trial, a counter FIR was registered in which he is now an accused.

Given the facts of the present case, pre trial incarcera�on is not required and the present pe��on is allowed and interim order dated 19.09.2023 is made absolute. All pending miscellaneous applica�ons, if any, stand disposed of. Legal Aid Counsel shall be en�tled for his remunera�on in accordance with law. Registry to communicate this order to the concerned legal services authority enable them to release remunera�on of legal aid counsel in accordance with law.
