Prayer in CM No.6765-C of 2016 is for deciding the present appeal
in view of Full Bench decision of this Court in Ram Kishan and others v. Sheo Ram and others, 2008(1) PLR 1 , which has been upheld by the Hon'ble Supreme Court in Singh Ram (D) through LRs v. Sheo Ram and others, 2014(9) SCC 185 .
Learned counsel for non-applicant/appellant submits that the matter has, in fact, been amicably resolved between the parties and he has instructions to withdraw the appeal itself.

At this stage, learned counsel for the applicant/respondents denies any amicable resolution of the dispute between the parties.
Mr. Saggar, learned senior counsel for the appellant however submits that he, in any case, has instructions to withdraw the appeal.
At request and with consent of learned counsel for the parties, the main appeal, which is listed at Sr.No.410 on the regular board of this Court, is taken up for hearing today itself.
In view of the above, appeal is dismissed as withdrawn.
