This order shall dispose of Civil Revision No. 6118 of 2015 and 998 of 2016. Two separate revision petitions have been filed by the husband and the wife, respectively. They assail the correctness of the order passed by the Additional District Judge, Amritsar, while assessing the interim maintenance @ ₹ 20,000/- per month for the wife and ₹ 10,000/- per month

on 14.09.2017 the main divorce petition has been dismissed by the trial Court against which the appeal is pending.

The only issue, which requires consideration, is as to what is the appropriate amount for grant of maintenance pendente lite to the wife and minor daughter. The husband is working as a Deputy Superintendent of Police with the Punjab Police. As per his income-tax return for the assessment year 2016-17, his gross annual income was ₹10,55,000/approximately.

Keeping in view the aforesaid facts, the amount assessed by the Additional District Judge is inadequate. Accordingly, it is ordered that the wife shall be entitled to grant of maintenance pendente lite during the pendency of the divorce petition @ ₹ 30,000/- per month, whereas the minor child shall be entitled to the maintenance pendente lite @ ₹ 15,000/- per month from the date of divorce petition.

With these observations, both the revision petitions are disposed of. However, the parties shall be entitled to file an independent application before the First Appellate Court to assess the maintenance pendente lite . The Appellate Court will independently decide the application without being influenced by the observations made in the order.

The miscellaneous application(s) pending in both the revision petitions, if any, shall also stand disposed of.
