Case is being taken up for hearing through video conferencing. The petitioner seeks regular bail in FIR No. 86 dated 3.6.2020 under Sections 61 and 78 of Punjab Excise Act, 1914 and Sections 465, 468, 471 and 473 IPC registered at Police Station Bahawala, District Fazilka.

Custody certificate by way of affidavit of Deputy Superintendent, Central Jail, Ferozepur has been sent through e-mail of the Court Secretary of this Court and photocopy of the same is taken on record.

Learned counsel for the petitioner submits that the petitioner has been abducted by the police from his house on 02.6.2020 and his Scorpio car was also picked up by the police from the service station on 03.6.2020 which is clearly shown in the CCTV footage (Annexure P-3 Colly). Learned counsel also submits that in the present case recovery has been effected and he has been in custody since 03.6.2020. Excise Act and NDPS Act, he has been granted bail.

On the other hand, learned State counsel has opposed the bail application and submits that the petitioner has also been involved in other 11 cases under the Excise Act and one case under the NDPS Act.

As per the custody certificate, there are several other cases under the Excise Act and the NDPS Act pending against the petitioner and in all those case, he is on bail. The petitioner has been in custody since 03.6.2020. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars.

Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
