Learned counsel for the applicant states that the trial Court has since decreed the petition ex-parte. An application for setting aside of exparte decree has been filed, notice of which has been given to the opposite party.
Under the circumstances, the application is dismissed being infructuous. The applicant may approach the Court again if the ex-parte decree is set aside by the trial Court.
