Mr. Parveen Kumar Rohilla, learned counsel appearing on behalf of the petitioner submitted that after completion of contract, services of the petitioner were extended from time to time and during all this period, her record had been impeccable in the absence of any complaint. Till 22.04.2019, she has been working as Data Entry Operator but was not allowed to assess the department on the premise that she did not fulfill the conditions. In fact, petitioner acquired the knowledge that one respondent no.5, who was also working in the office as Lower Division Clerk made certain complaint against petitioner regarding her qualification as he wanted to blackmail her, much less sexually harassed resulting into registration of FIR no.260 dated 01.04.2017 under Sections 354, 506 and 509 of Indian Penal Code. The petitioner was served with a show cause notice which was duly replied whereby alleged computer certificate issued by one M/s Balaji Computer Center was emphatically denied. It was contended that on the date of appointment as per information received under Right to Information Act, the qualification for the post of Lower Division Clerk by way of direct recruitment was 10/10+2 (vocational) with at least 50% marks or equivalent and above (for ex-serviceman 10+2 only) or graduate from any Board/University recognized by the Government of Haryana with working knowledge of computer covering various topics i.e. computer fundamentals, operation of Internet/E-Mail, MS Office (MS Word, Excel and Power Point) passed type test in Hindi at the speed of 25 words per minute or in English at the speed of 30 words per minute respectively and data punching speed of 8000 keys depressions per hour on computer and must have passed
