This order of mine shall dispose of five revision petitions, aforementioned, directed against the decision dated 31.01.2015 rendered by the lower Appellate Court, whereby the miscellaneous appeal preferred by the Municipal Council, Bhiwani, against the order dated 18.09.2013, allowing the application under Order 39 Rules 1 and 2 of the Code of Civil Procedure, in a suit for declaration, has been allowed.

The trial Court granted the interim order restraining the Municipal Council Bhiwani/defendant not to demolish the construction. Concededly, the civil suit is pending consideration.

Without commenting upon the merit and demerit of the case, I deem it appropriate to dispose of the revision petitions with the direction to the trial Court to decide the suit, in accordance with law, as expeditiously as possible preferably within a period of one year from the date of receipt of the certified copy of this order. However, interim order dated 27.03.2015, in the meantime, shall continue.
