Learned counsel for the appellant, at the very outset, fairly states that in view of the observations made by the appellate authority in its order dated 25.7.2006, reproduced in para 10 of the grounds of appeal at page 10 of the paper book, he will supplement his appeal before the appellate authority and the appellate authority may be directed to pass a fresh order, in accordance with law, after granting due opportunity of being heard to the appellant.
Faced with the above, learned counsel for the respondents-defendants also fairly states that he has got no Kumar Amitobjection to the proposal put by the learned counsel for the appellant. 2014.03.06 10:56 I attest to the accuracy and integrity of this document

In view of the above statements made by learned counsel for the parties, instant appeal is allowed and the matter is remitted back to the appellate authority. Appellant shall be permitted to supplement his appeal before the appellate authority within a period of one month from the date of receipt of certified copy of the order. Thereafter, the appellate authority shall pass a fresh and speaking order, in accordance with law, after granting due opportunity of being heard to the appellant.
With the observations made hereinabove, instant appeal stands allowed, however, with no order as to costs.
All the pending applications stand disposed of,
accordingly.
