It has been alleged that appellant-plaintiff is owner in possession of the land described in detail in the first para of the plaint. He was in need of Rs.50,000/- and he asked the defendant to give him this amount. The defendant gave him loan of Rs.50,000/- and got the agreement to sell dated 26/05/2000 written whereby it was told to the plaintiff that when he would return the money back, then he would destroy that agreement to sell. But plaintiff failed to return the money in time. Then defendant filed a suit for Specific Performance as per agreement to sell dated 26/05/2000. In that suit, a compromise was entered into and as per that compromise date of registration of the sale deed was fixed for 25/05/2003 and further it was agreed that if the plaintiff would not get the sale deed registered, he would be liable to pay double amount of earnest money Rs.61,600/-. It was further agreed that if plaintiff would be interested in getting the sale deed registered, he would get it registered and if Gopi Chand would not get the sale deed registered, then Dalip Singh would be entitled to get the double of the earnest money with interest @18% per annum through the court of law. After compromise, plaintiff paid Rs.61,600/- to the defendant. As per the compromise, defendant was only entitled to get Rs.61,600/-, but he is not at all entitled to get the sale deed registered in his favour.
