The mutation dated 23.03.2005 is now sought to be impugned belatedly after nine years. However, a question raised has been referred to a Full Bench of this Court in CWP-314-2001 vide order dated 02.09.2013.
In view of the aforesaid, we are inclined to accept the limited submission of learned counsel for the petitioner that dependent on the fate of the opinion to be rendered in the Full Bench judgment, the impugned mutation be dealt with.
The petition accordingly stands disposed of to abide by the result of the Full Bench judgment.
