This is not really a tender matter. The contract has already been executed between the parties. There is an arbitration clause. The allegation of the petitioner is that the forfeiture is taking place contrary to the terms of the contract and, thus, the allegation is of action beyond the contract for which the adjudicatory m achinery has already been provided through the mode of arbitration.
Learned counsel for the petitioner, faced with aforesaid position, seeks to withdraw the petition so as to move the competent forum for appropriate relief.
Dismissed as withdrawn with the aforesaid liberty.
