(1) Notice of motion to respondents No.1 to 3 only at this stage. Mr. RKS Brar, learned Addl. AG Haryana accepts notice on their behalf. In view of the nature of order which we propose to pass, no reply is required to be filed by the official respondents. Other respondents need not be served for the reason that no order prejudicial to their interest is being passed.

(2) The grievance of the petitioners who are the persons ‘living below poverty line’ is that though 100 sq. yards plots under the Mahatma Gandhi Gramin Basti Yojna formulated by the State Government vide policy circular dated 01.02.2008 have been allotted but they are yet to get actual physical possession of these plots. Instead, after running from pillar to post, the petitioners have come to know that the persons other than the beneficiaries

like them, whose names do not figure in the allottee’s list, have taken over possession over the plots allotted to the petitioners, in connivance with the Sarpanch of the Gram Panchayat.

(3) Having heard learned counsel for the petitioners, however, without expressing any views on the petitioners’ allegation, we deem it appropriate to dispose of this writ petition with a direction to the Deputy Commissioner, Bhiwani to verify the records, examine the claim of the petitioners and upon doing so, if their claim is accepted and/or the allegations leveled by them are found to be correct, let appropriate remedial action be taken in accordance with law.

(4) Let an appropriate order be passed within a period of four months from the date of receipt of a certified copy of this order.
