(1) The petitioners are allottees of tenements in the Housing Board Colony, Village Madlauda, District Panipat. The flats were allotted to them by the Haryana Housing Board. The grievance of the petitioners is against the speaking order dated 15.07.2013 (Annexure P10) which details out the cost amount/allotment price of the residential flats. The petitioners allege that the interest has been levied on 100% amount including 40% already paid by the allottees.

(2) The speaking order as well as the written statement filed by the respondents controverts the petitioners’ above-mentioned claim.

(3) Be that as it may, on the issue of mathematical calculations, it may not be expedient for this Court to express any views on the mathematical calculations as it is imperative upon the

respondent-authorities to determine the allotment price in a fair, just

and transparent manner and in accordance with the Governmentapproved criteria/policy.

(4) With a view to redress the grievance of the petitioners, we thus dispose of this writ petition with a direction that the petitioners may seek copy of the individual Statement of Accounts which shall be supplied by the respondents within two weeks of submission of application. If the petitioner(s) finds any irregularity, mistake or illegality in the calculation of the cost component of the flat allotted to them, he/she may represent against such Statement of Accounts and his/her representation shall be considered by the Committee comprising the Estate Officer and the Chief Accounts Officer of respondent-Board. It shall be appreciated if the Committee gives an opportunity of hearing to aggrieved representationist(s) also. The petitioner(s), if still left with any grievance, may submit appeal to the Chief Administrator who shall consider the same sympathetically and in a most compassionate manner. The Committee shall decide the representation(s) within a period of three months of its receipt and the appeal wherever preferred shall also be decided expeditiously.
