Learned counsel for the petitioner submits that since on remand by Financial Commissioner the appeal filed by the State before the Commissioner has been dismissed for non-prosecution, this petition has become infructuous.
Dismissed as infructuous. In case the said appeal is revived, petitioner will be at liberty to move appropriate application.
