The petitioners have prayed for a direction to the
respondents to grant them the Environmental Clearance Certificate
so that they may be able to run their brick-kiln under the Mines
and Minerals (Regulation and Development) Act, 1957.
Learned counsel submits that the petitioners have filed
the requisite Form-Annexure P/2, but no decision has been taken
with regard to issuance of Environmental Clearance Certificate.
Learned counsel has been apprised of the order passed
at Annexure P/6 dated 1.2.2014 by the State Expert Appraisal
Committee, Punjab, according to which the case of the petitioners
has been deferred in the light of the letter of the Ministry of
Environment & Forests, Government of India dated 25.2.2010.

Learned counsel submits that the State Expert Appraisal
Committee, Punjab may be directed to take up the petitioners’
case and decide the question whether the petitioners are entitled
to issuance of Environmental Clearance Certificate or not.
After hearing learned counsel for the petitioners, we
direct the State Expert Appraisal Committee, Punjab, which
functions under the Punjab Pollution Control Board, to take up
the case of the petitioners and decide the question whether
petitioners are entitled to be issued the Environmental Clearance
Certificate or not within a period of two months from the date of
receipt of certified copy of this order.
Disposed of.
