On the last date of hearing, learned counsel for the petitioners/ Union of India submitted that the issue raised in the present case is the same as in CWP No.2356-CAT of 2003 titled as Union of India and another vs. Bhupinder Kum ar and another, which has been reserved for judgment on 13.2.2014 and, thus, the consideration of the present matter was deferred. The judgment in that petition has been delivered on 21.3.2014 concluding that the writ petition was liable to be allowed and the order of the Tribunal was liable to be set aside.
The result of the aforesaid is that present petition is also allowed for the reasons recorded in the order in Union of India and another vs. Bhupinder Kumar and another case ( supra ) setting aside the impugned order.
The writ petition is accordingly allowed leaving the parties to
bear their own costs.
