Ajit Singh and Others Vs State of Haryana and Ors.

The petitioners' case is that their land situated within the revenue estate of village Kasan, Tehsil & District Gurgaon, was acquired vide notifications dated 26.6.2002 and 18.11.2002 issued under Sections 4 & 6 of the Land Acquisition Act, 1894 (hereinafter referred to as 'the Act'), respectively, followed by Award dated 20.05.2004. They did not file any reference under Section 18 of the Act but after decision of such references in the cases of other land-owners, an application under Section 28-A of the Act was filed by them on 04.04.2011 (Annexure P-1). It is their case that the aforesaid application has not been decided so far by the third respondent, namely, the Land Acquisition Collector, Gurgaon.

We thus dispose of this writ petition without expressing any views on the merits of the petitioners' claim, with a direction to respondent No.2 that if such an application is pending consideration, the same be decided in accordance
