should not be got scot-free, on which Gopi gave `datar' blow on his brother Sunny and Jasmeen and Parminder manhandled complainant's mother, also damaged the house-hold articles and also broke the door of the house. They also exchanged hot words and broke down the main door and windows. The reason for the fight was that earlier also they have a fight with them and case is also going on. It is stated in the petition that the reason for involving the petitioner in the case is that earlier he got registered FIR No.40 dated 2.3.2008 for the offences under Sections 307, 323, 324, 341, 148 and 149 IPC against the complainant party and others. The trial of the same was going on at the relevant time. The complainant party pressurized the petitioner to get the matter compromised, but on his refusal to do so, they manipulated and got registered the above FIR against him and 8 others. After registration of the FIR against each other, the respectable persons of the area intervened in October 2009 and the matter was compromised between both the parties in order to maintain harmony in the village as they belong to the same locality. The matter has already been compromised and amicable settlement has been arrived at between the parties, therefore, the complainant party got recorded their statements in favour of the accused. The trial Court finding no case against them acquitted all the accused vide order dated 24.1.2011 (Annexure-P.2). After the acquittal order passed by the Court on 24.1.2011, the petitioner came to know that he has been declared as proclaimed offender vide order dated 17.11.2009 (Annexure-P.3).
