The petitioners seek the concession of pre-arrest bail in a case registered at the instance of complainant Shivani alleging that she was married to petitioners' son Naresh Kumar on 14.10.2007. Huge amount was spent on the marriage. She was treated with cruelty by her husband and other family members. The petitioners happen to be father-in-law and mother-in-law of the complainant. They are admittedly 73 and 67 years old respectively.

Counsel for the complainant has opposed the petition for prearrest bail contending that there are specific allegations against them and that recoveries have to be effected from them.

Pursuant to the interim order, the petitioners have paid a sum of Rs.2.50 lacs to the complainant in lieu of 10 tolas of gold jewellery, which is allegedly yet to be recovered. Taking into consideration the age and the ailment of the petitioners, which is apparent from the documents, they can be granted the concession of pre-arrest bail.

Accordingly, the petition is allowed and it is ordered that in case of arrest of the petitioners, they will be released on bail to the satisfaction of the arresting officer subject to the condition that the petitioner will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation. This order will remain operative till the presentation of challan. In case of presentation of challan, the petitioners will be required to furnish fresh bail bonds/ surety bonds to the satisfaction of the trial court.
