Petitioner seeks the concession of pre-arrest bail in a case registered at the instance of Ram Murti alleging that the petitioner inflicted a kirpan blow on the head of the complainant resulting in grievous injury.

Counsel for the petitioner submits that there is a delay in lodging of FIR and that the petition of co-accused who had not been attributed grievous injury is pending before this Court.

ground is made out to grant the concession of pre-arrest bail to the petitioner.

Dismissed without prejudice to the rights of the petitioner to seek the concession of regular bail.

At this stage counsel for the petitioner submits that a direction be issued to the Illaqa Magistrate to consider the application of regular bail of the petitioner on his appearance before the Court, expeditiously.

Without expression of any opinion on merits of the case, it is directed that in case the petitioner surrenders before the Illaqa Magistrate within a period of one week, the trial Court shall make earnest endeavour to decide the bail application expeditiously, in case a request is made to that effect by the petitioner or his counsel.
