6.9.2011 and 12.3.2012 were addressed to the Director General of Police, Punjab, by the petitioners which were sent to the Senior Superintendent of Police, the Superintendent of Police and the Station House Officer of Police Station, Samrala, for inquiry. He further submits that vide inquiry report dated, 23.5.2012, the Superintendent of Police (Headquarter), Khanna, came to the conclusion that the contents of the applications dated 6.9.2011 and 12.3.2012 were false, therefore, a decision was taken by the Superintendent of Police to direct the Station House Officer, Police Station, Samrala, to file a criminal complaint (Calendra) under Section 182, IPC, for the prosecution of the petitioners. Resultantly, the criminal complaint (Calendra) dated 31.7.2012 (Annexure P-4) was presented by the Station House Officer, Police Station, Samrala, before the learned Sub-Divisional Judicial Magistrate, Khanna. He further submits that the applications dated 6.9.2011 and 12.3.2012 (Annexures P-1 & P-2, respectively) were addressed to the Director General of Police, Punjab, and even if the contents of the same were found to be false, the criminal complaint (Calendra) under Section 182, IPC, could not be presented by the Station House Officer of Police Station, Samrala.
