Prayer in this petition filed under Section 439, Cr.P.C., is for grant of regular bail to petitioner-Karam Singh, who was booked for having committed the offences punishable under Sections 325, 326 and 506, IPC, in a case arising out of FIR No.39, dated 15.03.2013, registered at Police Station, Longowal, District Sangrur.

Learned counsel contends that it is third application for grant of bail before this Court. The first application was dismissed as withdrawn on 03.09.2013 while the another was dismissed as withdrawn on 11.10.2013. He further contends that during the pendency of the investigation, better sense has prevailed and the injured-Jagjit Singh effected a compromise with the petitioner. It has also been contended that on the basis of compromise, a petition under Section 482, Cr.P.C., for quashing of the FIR and the consequential proceedings arising therefrom has been filed before

this Court in which the statements of the injured and the petitioner have been recorded by the learned trial court. Even the report has been received from the learned trial court in the said petition. He also submits that the petitioner is behind the bars from 18.3.2013. Learned counsel for the State, on instructions from HC Jarnail Singh, Police Station, Longowal, District Sangrur, has not denied the factum of compromise. He also admits that the injured, Jagjit Singh, did appear before the court below and got recorded his statement with regard to compromise.

In view of the totality of the facts and circumstances of the case, the present petition is allowed. Petitioner-Karam Singh, s/o Dalip Singh, r/o village Bahadurpur, P.S.Longowal, Tehsil and District Sangrur, is ordered to be released on bail during the pendency of the trial subject to his furnishing bail bonds to the satisfaction of the learned trial court.
