Raj has not yet been arrested. Petitioner has been involved in the case on the basis of the disclosure statement of Dharmender who has been granted bail.

The evidentiary value of statement of Dharmender indicting petitioner as an accused in statement made to the police will be a debatable issue during the course of trial. Petitioner has been in custody since November 13, 2013.

Without expression of any opinion on merits of the case, the petition is allowed. Petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial Court.
