Prayer in this petition filed under Section 439, Cr.P.C, is for grant of bail to the petitioner Surinder Singh son of Raj Kumar, who was booked for having committed the offences punishable under Sections 212, 394, 397 and 412 read with Section 120-B, IPC, as well as Section 25 of the Arms Act, in a case arising out of FIR No.313, dated 05.08.2012, registered at Police Station, Sadar, Fatehabad.

Learned counsel contends that the petitioner has been charge-sheeted for the offences punishable under Section 412, IPC, and Section 25 of the Arms Act only; concededly, the petitioner was not involved in committing the robbery or dacoity; the petitioner is behind the bars from 09.08.2012, i.e. for the last about two years.; the co-accused of the petitioner has already been granted bail vide order dated 29.11.2013 by this Court; and that the petitioner is neither required nor involved in any other case.

Learned counsel for the State, on instructions from ASI Nirmaljit Singh, very fairly concedes that the car allegedly used in the crime was recovered from the petitioner. She further concedes that the petitioner is neither required nor involved in any other case.

I have heard the learned counsel for the parties and with their able assistance gone through the material available on record.

Earlier, the application for grant of regular bail was dismissed as withdrawn on 30.04.2013. The petitioner is behind the bars for the last two years. The petitioner has been chargesheeted under Section 412, IPC, and Section 25 of the Arms Act.

Keeping in view the totality of the facts and circumstances of the case, the present petition is allowed and the petitioner, Surinder Singh son of Raj Kumar, r/o Shanti Nagar, Ward No.11, Sirsa, is ordered to be released on bail during the pendency of the trial subject to his furnishing bail bonds in the sum of ` 75,000/- with two sureties in the like amount to the satisfaction of the learned Chief Judicial Magistrate/Duty Magistrate, Fatehabad.
