Petitioner Soma has filed this petition under Section 439 of Code of Criminal Procedure (for short 'Cr.P.C.') seeking regular bail in case FIR No.115 dated 28.11.2013 registered at Police Station Bakshiwala, District Patiala for offences punishable under Sections 307, 323 read with Section 34 of Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has not been attributed any injury in this case. Both the petitioner and her husband are in jail and there is no one to look after the kids in the family. Gulzaro, mother of petitioner, has been declared innocent. The petitioner

was arrested in this case on 06.12.2013 and challan has been presented on 04.03.2014.

Perusal of the allegations contained in the FIR shows that petitioner has not been attributed any injury. Keeping in view this fact and without expressing any opinion on merits of the case, the present petition is allowed. Petitioner Soma is ordered to be released on regular bail on furnishing bail bond and surety bond to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Patiala subject to following terms:-

a. The accused shall comply with the conditions mentioned in Section 437(3) Cr.P.C.

b. In the event of her absence on any date of hearing, the benefit of bail allowed to the petitioner shall stand withdrawn. The trial Court shall be competent to cancel her bail bond and surety bond and proceed to procure her presence in accordance with law. In that eventuality the accused shall have to apply for bail afresh before the trial Court.

c. She shall not leave the country without the previous permission of the Court.
