After arguing for some time, learned counsel for the petitioner on instructions from the petitioner-tenant, who is stated to be present in the Court, seeks permission to withdraw the petition. The only request made by the petitioner is that he be allowed to arrange some other premises for his business of photography by allowing time till 30.04.2015.
Dismissed as withdrawn. However, the request of petitioner is allowed by granting time upto 30.04.2015 to vacate the shop in question, subject to the following terms:-
(i) The petitioner-tenant will file affidavit before the Rent Controller within a fortnight, undertaking to vacate the shop in question and hand over the vacant possession to the landlord on or before 30.04.2015.

(ii) He will pay the entire rent upto 31.10.2014 within two weeks.
(iii) He will keep on paying the advance rent of subsequent months upto 30.04.2015 on or before 7th day of each month.
In case of his failure to comply with any of the terms mentioned above, the executing Court will be at liberty to execute the eviction order.
The order has been passed in the absence of respondent to avoid unnecessary delay and expenses. A copy of this order be conveyed to the respondent. In the event of respondent having any objection, she may file a petition to that effect. On receipt of the petition, the same be put up for hearing.
