Plaintiff appellant is in second appeal against the concurrent judgments and decrees passed by both the Courts below whereby his suit for declaration and mandatory injunction was dismissed by the learned Civil Judge (Sr.Div.)Patiala on 8.11.2004 and the findings thereof were affirmed by the learned Addl.Distt.Judge, Patiala on 7.2.2006. Hence the present second appeal in which notice of motion was issued vide order dated 8.1.2007 and respondents remain to be served.
In the meanwhile CM No.13637-C/2013 has been filed on
behalf of the appellant praying for withdrawal of the instant appeal having become infructuous. The application is supported by theJoshi Rajinder Prashad 2013.12.19 12:57 I attest to the accuracy of this Order. High Court, Chandigarh.
