This letters patent appeal is directed against the order dated 14.2.2013 whereby the learned Single Judge has dismissed the writ petition preferred by the appellant on the ground that he did not disclose the factum of pendency of civil suit in the writ petition.
Heard learned counsel for the appellant.
Since the writ petition was only for implementation of
an order statedly passed in favour of the appellant under Section 133 Cr.P.C., by the Sub Divisional Officer (Civil), we dismiss this appeal with liberty to the appellant to seek execution of the said
order through appropriate proceedings under the Code of Civil Procedure. Needless to say that the Competent Authority shall be

required to take necessary steps in accordance with law as and
when such an application is moved by the appellant.
Ordered accordingly.
