Learned counsel for the petitioners relies upon the zimni orders, Annexure P-13 (Colly), to contend inter alia that his application dated 15.11.2011 (Annexure P-9), seeking setting aside of ex parte proceedings dated 08.12.2011 was never decided and on the other hand his application for stay is not being considered by the Financial Commissioner. Thus, the petitioners have got bona fide apprehension that in the absence of considering and deciding their stay application, their revision itself may not get infructuous.

In view of the above, the present petition is disposed of with a direction that the operation of orders dated 29.11.2012 (Annexure P-10) and 10.01.2013, Annexure P-11 (Colly ), shall remain stayed till the stay matter is heard and decided by the Financial Commissioner. Further, the Financial Commissioner is directed to consider and decide

the stay matter at an early date preferably within a period of three months from the date of receipt of a certified copy of this order.
