One of the contentions raised by the petitioners is that their specific plea taken before the Tribunal that on merits the respondents are not entitled to the special benefits, has not been expressly dealt with by the Tribunal while passing the order dated 14.12.2012. It is asserted that since the Hon'ble Supreme Court while declining to interfere with the order passed by the Benglore Bench of the Tribunal, has left open the question of law, the Tribunal ought to have decided the claim on merits.
As prayed for, the writ petition is dismissed as withdrawn with liberty to the petitioners to approach the Tribunal and seek review of the order dated 14.12.2012.
