taking divorce from Iqbal Singh and has no grudge against accused if she is granted divorce. It is also correct that now complainant has been granted divorce as a judgment passed in divorce petition filed by complainant Kamaljit Kaur is attached with the appeal file. Complainant has also admitted in her cross examination that she has received the dowry articles, which were recovered by the police from accused and accused are also suffering a trauma of trial for about 6 years. Accused/appellants are not previous convicts. Therefore, considering the facts and circumstances of the case and antecedents of accused/appellants, a good case is made out for giving the benefit of probation to the accused. Therefore, order of sentence is modified and appellants are ordered to be released on probation on furnishing their probation bonds in the sum of Rs.10,000/- with one surety each in the like amount, undertaking to appear and receive the sentence whenever called within a period of one year and in the meanwhile, to keep peace and be of a good behaviour. The sentence of fine is converted into costs of proceedings. Lower Court file be returned immediately, while appeal file be consigned to the Record Room.......”
