The petitioner is a Resident Welfare Association of Noor City, a residential locality developed by respondent No. 8-M/s Singla Builders & Promoters (P) Ltd.

The petitioner through this writ petition seeks various directions including :-

(i) to direct the Local Government Department to take over the residential colony of the petitioner within the purview of the Punjab Apartment and Property Regulation Act, 1995;

(ii) to direct the Builder-cum-Developer-respondent No.8 to provide all basic amenities and demolish all illegal constructions; and

(iii) to direct the State Authorities to take action for noncompliance of statutory provisions of the Punjab

The case of the petitioner appears to be that in violation of the approved building plans/site plans the respondent-Builder is constructing some commercial undersize shops/booths as well as flats etc., and it would impair the utility of the dwelling units of the members of the petitioner association. It is also averred that basic amenities such as clean drinking water supply is not being provided.

We find from the record that the petitioner association has sent various complaints to different authorities and finding no action thereon that the instant writ petition has been filed. We, thus, dispose of this writ petition without expressing any view on the merits of the case with a direction to respondents No. 2, 3, 4, 5 & 6 to consider the complaints-cumrepresentations received by them from the petitioner association with reference to their respective responsibilities/duties. The petitioner shall be at liberty to supplement their earlier representations to different authorities within a period of two weeks from the date of receipt of certified copy of this order. The above named respondents are directed to look into and redress the grievances of the petitioner-association in accordance with law as early as possible but not later then four months from the date of receipt of supplement representation(s).
