Aggrieved by the penalty of stoppage of one increment with cumulative effect, the petitioner has filed an appeal before the Appellate Authority i.e. Director General, Defence Research and Development Organisation, New Delhi.

Counsel for the petitioner submits that at this stage, petitioner will be satisfied in case a direction is issued to the Appellate Authority to consider the appeal filed by the petitioner on December 4, 2012 expeditiously.

Without expression of any opinion on the merits of the case or the maintainability of the petition, in the interest of justice, this petition is disposed of with a direction to Appellate Authority, respondent No.6, to decide the statutory appeal of the petitioner within a period of six months after the receipt of a certified copy of this order. In case the petitioner seeks an opportunity of appearance before the Appellate Authority, he will be granted permission to appear before the Appellate Authority.
