The petitioner has challenged the order dated 28.6.2013 passed by respondent No.1 in pursuance of the order dated 15.3.2013 passed by this Court in C.W.P. No.22239 of 2012, by not resorting to the procedure prescribed under Section 16(1)(a) of the Punjab Municipal Act, 1911. The concern shown by the petitioner is that respondent No.5, who is on caveat has been convicted for a period of six months for offence committed under the Arms Act, 1959 and only his sentence has been suspended and not the conviction in the appeal No.384-DB of 2008 filed by him. It is submitted that in pursuant to the order passed by this Court, he had only resigned from the post of President of the Municipal Council and not as Member though he is liable to step down as a Member as well and may not again contest

for the post of President of the Municipal Council during the present term.
Learned counsel for the respondent, however, submits that the present term is going to expire on 25.7.2013 and has given undertaking before this Court that respondent No.3 shall not contest for the post of President of the Municipal Council during the present term of the Municipal Council. This undertaking given by respondent No.3 in Court today, satisfies counsel for the petitioner.
