Pursuant to the order dated 05.03.2013 passed in L.P.A. No.466 of 2013 giving liberty to the parties to explain circumstances arising out of alleged negligence on the part of the 4th respondent-Union of India. The appeal had been filed against the interim order dated 07.11.2012 imposing Rs.30,000/- as costs on account of non-filing of the reply by the 4th respondent. It was further ordered that recovery would be effected from the personal pay of the officer responsible for filing the affidavit in Court. The second order that was impugned before the Letters Patent Bench was the interim order dated 31.01.2013, which enlarged the time for deposit of costs. Mr. Karminder Singh appears for the 5th respondent as well. He submits that the medal had to be awarded by the 5th respondent and not by

the 4th respondent to the petitioner. The General Manager, India Government Mint Alipore, Kolkatta and the Post Master, Head Post Office, Kolkatta were ordered to be impleaded as respondent Nos.5 and 6, respectively, vide order dated 16.09.2011. Mr. Karminder Singh appears for respondent No.5 in addition to respondent No.4.
In view of the circumstances explained by him today, orders dated 07.11.2012 and 31.01.2013 are recalled.
On the request of learned counsel for the petitioner, the matter was taken up at the post-lunch session. At this stage, learned counsel for the petitioner submits that he has received instructions from his client that the medal which was subject matter of the writ petition has been received by him. This renders the writ petition infructuous.
Dismissed as such.
