The petitioner, who is serving as a Language Teacher in the State Education Department had applied for the post of PGT (Hindi) in response to advertisement dated 07.06.2012 issued by the Haryana School Teachers Selection Board. Vide memo dated 18.04.2013, the candidature of the petitioner has been rejected on the ground that she is over age as on the cut off date/closing date. Vide memo dated 29.04.2013 itself, the petitioner was called upon to submit the requisite documents to claim age relaxation as available to government employees over a period of five years and to submit such certificate in the office of Secretary, Haryana School Teachers Selection Board within a period of 15 days of the receipt of the memo.

Counsel for the petitioner would submit that memo dated 18.04.2013 (Annexure P-7) was dispatched on 29.04.13 and was received by the petitioner on 03.05.2013.

The instant writ petition has been filed raising a grievance that till date the application submitted by the petitioner to her employer for

issuance of age relaxation certificate has not been processed and which resultantly is causing the non consideration of her claim for the post of PGT (Hindi).

In the light of the facts noticed hereinabove and without making any observations as regards the correctness of the claim raised in the petition, I deem it appropriate to dispose of the present writ petition with a direction to respondents No. 2, 3, 4 & 6 to process the application dated 04.03.2012 (Annexure P-4) submitted by the petitioner for issuance of the requisite upper age relaxation certificate in relation to the post of PGT (Hindi) as per law within a period of 10 days from the date of receipt of a certified copy of this order.

It is further clarified that in the eventuality of the petitioner being issued the requisite age relaxation certificate, the same shall be entertained and accepted by the Haryana School Teachers Selection Board without raising the objection of delay as regards the stipulated time frame of 15 days contained in the memo dated 18.04.2013 (Annexure P-7).
