(1). The petitioners, at the time of institution of this writ petition, were working as Accountants in one or the other Municipal Corporations in the State of Punjab. They approached this Court seeking a direction for their promotion to the posts of Accounts Officer and also for a writ of prohibition to restrain the authorities from confirming the services of private respondents who were brought as Senior Accounts Officers on deputation.

The official respondents No.1 & 2 have filed their written statement maintaining that the posts of Accounts Officers (redesignated as Deputy Controller Finance & Accounts) were filled up through deputation from the Finance Department as no employee including the petitioners fulfilled the requisite qualifications for these

posts. It has further been explained that the re-designated post of Deputy Controller, Finance & Account is a Class-I promotional post and is two steps higher than the post of Section Officer for which the minimum qualification is Subordinate Account Service and none of the petitioners possess that qualification.

(3). I have heard learned counsel for the parties and gone through the record.

The above-stated grievance was raised by the petitioners in the year 1994 and the plea taken on behalf of the official respondents, referred to above, is also contained in the reply dated 24.03.1994. Much water has flown thereafter. It is quite possible that the petitioners or other regular employees of the Corporation have meanwhile acquired the requisite qualification prescribed for the posts in question. If that is so and if it so permissible under the Rules, there would be no impediment against consideration of the claim of such eligible employees for promotion in accordance with the statutory rules.

(5). Ordered accordingly.

(6). The needful shall be done by the respondents within a period of six months from the date of receipt of a certified copy of this order.
