Prayer in this petition is for grant of regular bail to the petitioner, Gursewak Singh @ Sewak Singh @ Kaka, son of Parampal Singh @ Pala Singh, resident of Village Kikkar Khera, District Fazilka, who has been booked for having committed the offences punishable under Sections 323, 324, 326, 341 and 506 read with Section 34, IPC, in a case arising out of FIR No. 49, dated 27.5.2013, registered at Police Station, Bahaw Wala, District Fazilka.

Learned counsel contends that all the offences for which the petitioner has been booked are triable by learned Judicial Magistrate Ist Class; that the petitioner is behind the bars from 16.8.2013; and that during the pendency of the investigation, the better sense has prevailed and the private parties have sorted out their disputes and effected a compromise.

Ranjit Singh of Police Station, Bahaw Wala, District Fazilka, very fairly concedes that during investigation of the case, the affected parties have sorted out their disputes and effected a compromise. He further concedes that the petitioner is behind the bars from 16.8.2013. It has also been conceded that all the offences for which the petitioner has been booked are triable by the learned Judicial Magistrate Ist Class.

I have heard learned counsel for the parties and gone through the material available on record.

Keeping in view the totality of the facts and circumstances of the case, the present petition for grant of regular bail to the petitioner, Gursewak Singh @ Sewak Singh @ Kaka, son of Parampal Singh @ Pala Singh, resident of Village Kikkar Khera, District Fazilka, is allowed. He is ordered to be released on bail during pendency of the trial of the present case, subject to his furnishing bail bonds to the satisfaction of the learned Sub-Divisional Judicial Magistrate/Duty Magistrate, Abohar.
