Learned counsel for the petitioner submits that in the presence of the police, the possession of the plot in dispute has been delivered to the complainant on 21.02.2013.
The said fact has not been disputed by the learned counsel for the State. Learned counsel for the State further submits that the petitioner has already joined the investigation and no more required by the police for any other purpose.
Keeping in view the facts and circumstances of the case and the statements suffered by the learned counsel for the parties, the present petition is allowed and the order dated 15.11.2012 whereby the ad-interim anticipatory bail was granted to the petitioner, is made absolute.
The petitioner shall continue to join the investigation as and when required to do so and abide by all the conditions laid down under Section 438(2) Cr.P.C.
