This petition under Section 439 Cr.P.C is for grant of regular bail to the petitioners in case F.I.R No. 35 dated 26.05.2012 u/ss 307/341/323 IPC and Section 27/54/59 of Arms Act, registered at Police Station Bjaj Khana, Distt. Faridkot.

It is a case of version and cross version. The present F.I.R has been registered on the statement of Amandeep Singh and cross version has been registered on the statement of Iqbal Singh. The incident took place near the passage along with tubewell near the house of Iqbal Singh. After registration of the version and cross version, challans have been presented

and the trial has been proceeded. During investigation in F.I.R, the present petitioners were found to be innocent and further DSP, Sub Divn. Jaitu has also approved the innocence of the petitioners.

Learned State counsel on instructions from ASI Jagtar Singh has informed the Court that the challan has been presented on 10.04.2013 and the charges have been framed on 13.06.2013 and material witnesses i.e Gurjant Singh, Malkeet Singh and Gurmeet Singh have been examined on 19.10.2013. The petitioners are in custody since 17.01.2013.

Since out of 19, only 4 witnesses have been examined so far and Nothing is to be recovered from the petitioners, therefore no useful purpose would be served by detaining them during the pendency of trial.

Heard.

Keeping in view the period of incarceration of the petitioners and the fact that trial may still take some time to conclude, this court feels that there is no need to detain the petitioner any longer. Accordingly, the petition is allowed and petitioners are ordered to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Faridkot.
