Instant petition has been filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the petitioner in FIR No.15 dated 07.02.2011, registered at Police Station Sri Hargobind Pur, Batala, under Sections 302/34 IPC and 25, 27, 54 of the Arms Act.
Heard learned counsel for the parties.
There is specific allegation that firstly, co-accused Sukhdev fired a shot in the chest of deceased-Dilbagh Singh and he ran away. Thereafter, petitioner after taking revolver from Sukhdev Singh fired another shot which hit on the back of deceased-Dilbagh Singh, as one of co-accused Sarwan Singh encircled him, when he tried to run away.
Keeping in view the specific role attributed to the petitioner that after snatching revolver from co-accused Sukhdev, he fired a shot on the

deceased, no ground for bail is made out. Otherwise also, this is a second bail application and no fresh grounds are forthcoming.
