The present petition filed under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioner in case FIR No.41, dated 26.2.2007, under Sections 336, 323, 148, 149 IPC and under Section 25 of the Arms Act, registered at Police Station Dharamkot, District Moga.
Learned counsel for the petitioner requests for withdrawal of this petition.
Dismissed as withdrawn.
However, it has been contended by learned counsel for the petitioner-accused that petitioner is ready to surrender before learned trial Court and apply for regular bail.
Hence, petitioner is directed to surrender before learned trial Court within two weeks from today and if he so appears and applies for regular bail, learned trial Court is directed to decide the same on merit on the same day.
