This petition has been filed u/s 482 Cr.P.C. for directing respondents No.1 to 3 to protect their lives and liberty and from interference in their married life by respondents No.4 and 5.

In pursuance of the notice of motion issued on 22.4.2013, respondents No.4 and 5 are present in Court. They are accompanied by ASI Rampal Singh, Police Station Nihal Vihar, New Delhi.

Learned counsel appearing on behalf of respondents No.4 and 5 states that petitioner No.1 is a minor, her date of birth being 7.12.1995. She has placed on record a photocopy of the document issued by the school last attended by petitioner No.1 wherein her date of birth has been recorded.

Petitioner No.1 has stated in the Court that she wants to accompany her father – respondent No.4. In view of this, Nari Niketan

Crl. Misc. No. M-12531 of 2013 (O&M) -: 2 :-

authorities are directed to release petitioner No.1 and hand over her custody to respondent No.4 against proper receipt and identification. Petitioner No.2 shall also be released from the Protection Home, Chandigarh.

ASI Rampal Singh, present in Court, states that FIR No.124 dated 19.4.2013, P.S. Nihal Vihar, Delhi has been registered against petitioner No.2 for the offence of kidnapping. The police authorities of Delhi will be at liberty to proceed in accordance with law in connection with aforesaid FIR.

The original Aadhar Cards of the petitioners, placed on record by them, are returned to them against proper receipt and photocopy of the same is retained on record.

Copy of the order under the signatures of the Bench Secretary be supplied to the concerned authorities.
