Petitioner-Yunus @ Nusa son of Mehfooz, has directed the instant petition for the grant of regular bail, registered against him along with other co-accused, by way of FIR No.22 dated 31.01.2013, on accusation of having committed the offences punishable under Sections 148, 323, 324, 341, 452, 506 & 307 read with Section 149 IPC, by the police of Police Station Chhachhrauli, District Yamuna Nagar, invoking the provisions of Section 439 Cr.P.C.

subject matter of offence punishable under Section 307 IPC, is assigned to the main accused Ashu (non-petitioner), having been caused to injured Israna. In that eventuality, whether the provisions of Section 307 read with Section 149 IPC, are attracted to the case of the petitioner or not, would be a moot point to be decided during the course of trial by the trial Court.
Needless to mention that, nothing observed here-in-above, would reflect, in any manner, on merits of the case, as the same has been so recorded for a limited purpose of deciding the present petition for regular bail.
