Prayer in this petition is for grant of anticipatory bail to petitioner-Bhale Ram, who has been summoned under Section 319, Cr.P.C for having committed the offence punishable under Section 304-B read with Section 34, IPC, in a case arising out of FIR No.121, dated 01.04.2011, registered at Police Station, Sadar, Panipat.

Learned counsel contends that during the course of investigation, the petitioner was found to be innocent by the investigating agency, therefore, the charge-sheet (report under Section 173, Cr.P.C) was not presented against him. He further submits that co-accused Usha, mother-in-law of the deceased and wife of the petitioner, has already been granted the regular bail by this Court. He further submits that in compliance of the order dated 15.01.2013, the petitioner did appear before the court below and admitted to ad-interim bail on 17.01.2013.

Learned counsel for the State has not controverted the submission made by learned counsel for the petitioner with regard to his appearance before the learned trial court.

In view of the facts and circumstances of the case, the present petition is allowed and the order dated 15.01.2013 whereby the petitioner was ordered to be admitted on ad-interim bail on his appearance before the learned trial court, is made absolute.

The petitioner shall continue to appear before the trial court in compliance of the bail bonds furnished by him. The said bail bonds shall enure during the course of trial.
