Pursuant to a secret information that the petitioner along with two others was planning to rob the passengers near service station, situated at Narnaul road, the petitioner along with said persons attacked the police officials but was apprehended along with others. He was armed with a country made pistol.
Counsel for the petitioner has submitted that the petitioner has been falsely implicated, whereas State counsel, on the instructions of HC Tejpal Singh, informs that the petitioner is involved in 8 more cases. The material witnesses, who were none else but official witnesses, stand already examined. Chances of tampering with evidence are remote. The probability of the story put forth by the prosecution that the petitioner had actually attempted to rob the police officials, will be debatable.
The petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail bonds/ surety bonds to the satisfaction of the trial court, subject to a condition that the petitioner will not indulge in any activity of the kind, as alleged in the present FIR.
