Harbinder Singh Vs Bhupinder Singh and Anr.

Tenant no.1 is aggrieved against the order dated 5.9.2013 (P9) passed by the learned Appellate Authority,Mohali whereby in the pending appeal filed by the tenant against his eviction order dated 29.5.2013, his application under Order 41 Rule 5 CPC praying for interim stay of the eviction decree has been dismissed.

It is apparent that stay has been declined in view of the fact that possession of the demised premises has been handed over to the landlord through the process of the Court and therefore, prayer for stay of recovery of arrears of rent, as determined by the learned Rent Controller, was also not acceded to.

At the time of hearing learned counsel for the petitioner tenant prays for permission to withdraw the present revision petition
